Arizona Wells: Notice of Intent and the 35 GPM Exempt Well
Arizona Wells: Notice of Intent and the 35 GPM Exempt Well
Short summary of the Arizona Department of Water Resources (ADWR) page on well drilling.
- You must file a Notice of Intent to Drill with ADWR, with the filing fee, before drilling a new well or deepening or modifying an existing one. The authority is valid for one year.
- A licensed well-drilling contractor must do the work.
- An exempt well is typically for domestic use and equipped to pump 35 gallons per minute or less. A non-exempt well has pump capacity above 35 gpm; in Active Management Areas it requires grandfathered rights, service area rights or withdrawal permits.
- ADWR regulates all groundwater wells and keeps a permanent record, citing A.R.S. 45-593 on registration of existing wells.
For pump choice, the 35 gpm figure is a pump capacity limit, so ask the driller to confirm the pump you buy stays within it. Not verified: fees, current forms, and whether your location is in an Active Management Area.
